These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by BldrTeam.com (“BldrTeam,” “we,” “us,” or “our”). By creating an account, accessing, or using the Services, you agree to these Terms. If you are acting on behalf of an organization, you represent that you have authority to bind that organization.
BldrTeam provides cloud-based software that helps home builders and construction companies manage projects, communications, and related workflows. We may add, modify, or discontinue features from time to time.
You must be at least 18 years old and capable of forming a binding contract to use the Services. You must provide accurate account information and keep your credentials confidential. You are responsible for activities that occur under your account.
Access to certain features may require a paid subscription. Fees, billing cycles, and payment terms are described in your order form or account settings. You authorize us or our payment processor to charge the payment method on file. We do not store payment card numbers on BldrTeam servers. All fees are non-refundable unless required by law. Late payments may result in suspension or termination.
You may enable integrations with third-party products, including accounting and payment systems. By enabling an integration, you authorize BldrTeam to exchange information with that provider as needed. These third parties are governed by their own terms and privacy policies; we are not responsible for their services.

Our Privacy Policy explains how we collect and use personal information. By using the Services, you consent to our data practices described in that policy. You are responsible for obtaining necessary rights and consents to submit data to the Services.
If you opt in to BldrTeam Text Messaging, you agree to receive account and project notification text messages about your account, projects, schedules, tasks, documents, approvals, and messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, START to resume, or HELP for help. Consent is not a condition of purchase or use of BldrTeam services. BldrTeam and its licensors retain all rights, title, and interest in the Services, including software, content, trademarks, and documentation. Using the Services does not transfer ownership to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes.
You retain ownership of content you upload to the Services (“Customer Content”). You grant BldrTeam a limited license to host, use, and display Customer Content solely to provide and support the Services. You represent that you have the rights to grant this license and that your content does not infringe third-party rights.
If you provide suggestions or feedback, you grant BldrTeam the right to use it without restriction or compensation.
Each party will protect the other party’s confidential information using the same degree of care it uses for its own confidential information, but no less than reasonable care. This obligation does not apply to information that is public, already known, independently developed, or required by law to be disclosed.
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, BldrTeam and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or revenues, arising out of or related to the Services or these Terms. Our total liability for any claim is limited to the amounts paid by you to BldrTeam for the Services during the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in such cases, these limitations apply to the extent permitted by law.
You will defend, indemnify, and hold harmless BldrTeam, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, Customer Content, or violation of these Terms.
You may terminate your account at any time via the account settings or by contacting support@bldrteam.com. We may suspend or terminate access if you breach these Terms or pose a risk to the Services. Upon termination, your right to use the Services ends, but certain provisions (including Sections 7–20) survive. We may provide tools to export Customer Content for a limited time after termination.
We may update the Services and these Terms from time to time. We will notify you of material changes via email or in-product notice. Continued use after the effective date of revised Terms constitutes acceptance.
These Terms are governed by the laws of the State of North Carolina and applicable federal law of the United States, without regard to conflict-of-law principles. You agree that the state and federal courts located in Raleigh, North Carolina have exclusive jurisdiction over any disputes arising out of or relating to the Services or these Terms, and you consent to personal jurisdiction in those courts.
These Terms constitute the entire agreement between you and BldrTeam regarding the Services and supersede prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our written consent. Our failure to enforce a provision is not a waiver of our right to do so later.
